ACCEPTANCE OF TERMS

By accessing or using the West Side Fly Guide website and services, you agree to be bound by these Terms and Conditions, our Privacy Policy, and any other policies referenced herein. If you do not agree to these terms, please do not use our services. Any new or updated features added to our website or services shall also be subject to these Terms.

“Website” refers to westsideflyguide.com, including all pages, sub-pages, and associated web-based applications. “We”, “Us”, and “Our” refer to West Side Fly Guide and its owner Westley Allen. “Visitor” is someone who browses the website but has not purchased products or services. “Customer” is someone who has purchased our products or services. “User” or “You” is a collective identifier referring to either a Visitor or Customer. “Products” refers to products available for purchase on our website. “Services” refers collectively to our guided trips, classes, content, and website.

By using our Services, you agree to comply with all applicable local, state, and federal laws, statutes, ordinances, and regulations. We reserve the right to investigate reported violations and take necessary action including canceling services or reporting suspected unlawful activity to appropriate authorities.

We reserve the right to make additions, modifications, or changes to these Terms at any time without prior notice. Changes will be effective when posted on this page. Your continued use of our Services after changes are posted constitutes your acceptance of the updated Terms. In cases of disputes, the version of these Terms at the time we receive your dispute notice will be applicable.

AUTHORIZED USERS

By using our Services you affirm that you are 18 years of age or older. To purchase through our website you must be 18 or older and have a valid credit card or other accepted payment method. You agree that you are only authorized to use our Services for personal use and not for any business purposes without a separate written agreement with us. You may not use our Services to purchase any product for resale, either directly or indirectly.

SERVICES

West Side Fly Guide offers half day guided fishing trips, full day guided fishing trips, fly tying classes, casting lessons, and an online shop selling flies and gear. All services are subject to availability and the terms described herein.

BOOKINGS AND PAYMENTS

All bookings are confirmed upon receipt of full or partial payment as specified at the time of booking. Prices are subject to change without notice. West Side Fly Guide reserves the right to refuse service to anyone at its discretion. You agree to provide current, complete, and accurate information for all purchases and to promptly update your information as needed so that we can complete your transactions and contact you as needed.

CANCELLATION AND REFUND POLICY

Guided Trips and Classes. Cancellations made more than 30 days before your scheduled trip or class date will receive a full refund. Cancellations made between 14 and 30 days before your scheduled date are not eligible for a refund but may be rescheduled one time subject to availability. Cancellations made less than 14 days before your scheduled date are non-refundable and are not eligible for rescheduling. No refunds will be issued for no-shows or late arrivals. In the case of a documented emergency, West Side Fly Guide may at its sole discretion consider exceptions to this policy on a case by case basis.

If West Side Fly Guide cancels a trip due to unsafe weather conditions, dangerous river levels, or other circumstances beyond our control, you will receive a full refund or the option to reschedule at no additional charge.

Online Shop. All sales of flies and gear through our online shop are subject to our Fly Shop Refunds and Returns policy, which can be found on our website.

ASSUMPTION OF RISK AND LIABILITY WAIVER

Fly fishing and outdoor activities involve inherent risks including but not limited to slipping on wet surfaces, fast moving water, inclement weather, wildlife encounters, and physical exertion. By booking a trip or class with West Side Fly Guide, you acknowledge and voluntarily assume all risks associated with fly fishing and outdoor activities.

To the fullest extent permitted by law, West Side Fly Guide, its owner, employees, and agents shall not be liable for any injury, death, loss, damage, or expense arising from your participation in any of our services, whether caused by negligence or otherwise. You agree to release, indemnify, and hold harmless West Side Fly Guide and its owner from any and all claims, damages, or liabilities arising from your participation in our services.

Participants are responsible for their own physical fitness and health. West Side Fly Guide reserves the right to refuse participation to anyone deemed unfit to safely participate in activities.

FISHING LICENSES AND REGULATIONS

All clients are responsible for obtaining and carrying a valid fishing license for the state in which the guided trip takes place. Clients are responsible for knowing and following all applicable fishing regulations. West Side Fly Guide is not responsible for any fines or penalties resulting from a client’s failure to comply with licensing or regulatory requirements.

INDEMNIFICATION

You agree to indemnify, defend, and hold harmless West Side Fly Guide and its owner, agents, contractors, service providers, and employees from any claim or demand, including reasonable attorneys fees, made by any third party due to or arising out of your breach of these Terms and Conditions, your violation of any law, or your violation of the rights of any third party.

PROHIBITED USES

Users are prohibited from using our website or its content for any unlawful purpose, to solicit others to perform unlawful acts, to violate any applicable laws or regulations, to infringe upon the intellectual property rights of others, to harass, abuse, insult, harm, defame, or discriminate against any person, to submit false or misleading information, to upload or transmit viruses or any malicious code, to collect or track the personal information of others, to spam, phish, or scrape our website, for any obscene or immoral purpose, or to interfere with or circumvent the security features of our website. We reserve the right to terminate your use of our Services for violating any of these prohibited uses.

All content on the West Side Fly Guide website including text, images, logos, and graphics is the property of West Side Fly Guide and may not be reproduced, distributed, or used without prior written permission. AVAILABILITY OF SERVICES AND WARRANTY DISCLAIMER

Our Services may be temporarily unavailable from time to time for maintenance or other reasons. In no event will West Side Fly Guide or its owner, employees, or agents be liable to you or any third party for any indirect, consequential, exemplary, incidental, or punitive damages, including lost profits or lost data arising from your use of our Services or any related product accessed through our Services. West Side Fly Guide’s liability to you for any cause whatsoever shall at all times be limited to the amount you paid for the specific service giving rise to the claim.

ONLINE SHOP

All purchases made through our online shop are processed through Woocommerce. By making a purchase, you agree to Woocommerce terms of service. West Side Fly Guide is not responsible for delays in shipping caused by carriers or circumstances beyond our control. Risk of loss and title for items purchased pass to you upon delivery to the carrier.

LINKS TO THIRD PARTY SITES

Our website may contain links to third party websites including social media platforms and river data resources. We are not responsible for the content or practices of any linked third party sites and our inclusion of such links does not constitute endorsement of those sites or their content.

SEPARATION OF TERMS

Each of the provisions of these Terms operates separately. If any part of these Terms is not enforceable, the remaining Terms still apply and are binding. Any unenforceable term will be substituted with a term that comes as close as possible to the intent of the original term.

NO WAIVER

Our non-enforcement of any right under these Terms at any time does not mean we have waived that right. Any waiver of a provision of these Terms must be made in writing and will not constitute a waiver of any future breach or default.

ENTIRE AGREEMENT

These Terms and Conditions, together with our Privacy Policy and any other policies referenced herein, make up the entire agreement between you and West Side Fly Guide relating to your use of our Services and supersede all prior understandings, whether electronic, oral, or written.

TERMINATION

We may terminate this agreement with you at any time for any reason with or without cause, including but not limited to violation of these Terms, infringement of intellectual property rights, failure to comply with applicable laws, or publishing or distributing illegal material. Any provisions that by their nature should survive termination shall remain in full force and effect.

GOVERNING LAW

These Terms and Conditions shall be governed by and construed in accordance with the laws of the State of Michigan. Any disputes arising from these Terms or your use of our Services shall be resolved in the courts of the State of Michigan.
